Reconocimiento al derecho de autor.

Creen que al ser fotógrafo se puede uno autodenominar autor?…un autor es aquel que crea una obra artística en cualquiera de sus formas. Aun que hay muchas leyes involucradas en este concepto, a mí solo me interesa la parte que dice: que la obra en cuestión es una expresión original del autor.

 

NO es necesario que realice ningún acto legal para que sea así…

 

Según la ley

Para ser el autor de una obra artística, solo debemos crearla y obtenemos de inmediato todos los derechos sobre ella, copia, reproducción, exposición, etc.

Aun que la propiedad o derecho del autor solo protege creación en sí, la idea en ella o detrás de ella, no puede ser protegida.

 

Copiar

Si la copiamos estamos infringiendo la ley, y es aquí donde me detuve a pensar la situación real, con la tecnología actual es posible copiar casi cualquier obra que se pueda digitalizar, y si la publicamos en Internet, no hay forma de saber que ha sido violado ese derecho de autor.

Nuestras fotografías por ejemplo, podrían ser fácilmente copiadas y publicadas en otro lugar sin nuestro consentimiento, sin nuestro conocimiento…

 

Intención

Tal vez a algunos no les parecerá una atenuante, la intención detrás de esa copia, puesto que son celosos de su obra y quieren tener el control; incluso es probable que yo esté equivocado al pensar que si uso alguna fotografía en mi Blog, que encontré en algún lugar en internet, y si le agrego un link hacia la imagen original, de esta forma estoy reconociendo su autoría y sus derechos de autor.

 

Sobre todo al descubrir que mi intención no es lucrar, o adjudicarme ese derecho, no es plagio…en realidad me parece que se trata de un reconocimiento.

 

Usar una fotografía como parte de un contexto en el cual se presenta la fotografía como un buen ejemplo, digno de admirar, es un tributo a su creatividad.

 

Error

Tal vez mi error en ese sentido radica en que no he agregado al pie de la fotografía el nombre del autor, ese podría ser mi pecado de omisión.

 

Enmienda

A partir de hoy tendré mas cuidado con respecto a este detalle; posiblemente debería contactar al autor y solicitar su permiso, pero eso afectaría el flujo de mi trabajo, por lo que espero sea suficiente este articulo con la explicación del porque, para que en el futuro, todos aquellos que reciban un aumento en el trafico de visitantes a su obra y descubran que se debe a un link en este Blog, sepan que la intención es reconocer su arte.

 

Si usted cree que su trabajo ha sido copiando de tal forma que constituya una infracción a su derecho de autor, o si cree que los derechos de su propiedad intelectual han sido violados de alguna manera, por favor póngase en contacto conmigo.

Recognition of copyright.

To be the author of an artistic work, we just have to create it and immediately get all rights to it, copy, reproduce, display, etc..

COPY

If the copy we are breaking the law, and this is where I stopped to think about the real situation, with today’s technology you can copy almost any work that can be digitized and published on the Internet, and there is no way of knowing that has been violated the copyright.

Our photographs, for example, could easily be copied and published elsewhere without our consent, without our knowledge …

 

INTENT

Maybe someone do not look like a mitigating factor, the intention behind that copy, because they are jealous of their work and want to have control, even likely that I am wrong in thinking that if I use any pictures on my blog, I found somewhere on the internet, and if I add a link to the original image, so I am acknowledging their authorship and copyright.

 

Above all to discover that my intention is not profit, or get that right, is not plagiarism … actually I think it is a recognition.

 

Use a photograph as part of a context in which the photograph is presented as a good example, worthy of admiration, is a tribute to their creativity.

 

ERROR

Maybe my mistake in this regard is that I have not added at the bottom of the picture the name of the author, this could be my sin of omission.

 

AMENDMENT

Starting today I will have more careful about this detail, possibly should contact the author and ask for permission, but that would affect the flow of my work, so I hope this article with sufficient explanation of why, so that in the future, all those who receive an increase in traffic of visitors to your site and discovered to be a link on this blog, know that the intention is to recognize his art.
